What is the ARD Program?

We ALWAYS look for a better result.  In many cases, we have been able to achieve better outcomes including dismissal of DUI charges.

The ARD Program is probation without a verdict.   It is not a "class."  It is not an "online program."  It can be 12 to 18 months of probation.  It can be very expensive.

Each county in Pennsylvania has a different procedure for requesting and completing the ARD.  Therefore, it is important that you work with a lawyer like me, who knows the application process in each county.  For a FREE case evaluation click here.

How does a DUI/ARD affect my CDL?

Attorney Morgan literally grew up in the cab of a tractor trailer.  As the son of an Owner-Operator Truck Driver, Dean understands the importance of a CDL.

We work to protect your CDL.   If you have a CDL, your CDL will be disqualified for 12 months. I understand the importance of a CDL to your employment. We will work with your employer to explain the process and help them to help you maintain your employment.

Should I Fight My Charges?

You should consider it.  ARD is not the right choice for everyone.  It is the lesser of two evils.  Only after a full evaluation of your case can we determine if ARD is the right choice for you.   Although we cannot guarantee any particular outcome, we have had success with getting DUI charges completely dismissed for first time offenses.  When you complete our online case evaluation, we will send you our case results and our client reviews.

Am I eligible for the ARD Program?

First, let's find out if you are eligible. Complete this free online case evaluation by clicking here to either schedule your free consultation or receive a comprehensive case evaluation and recommendation.  There is no fee for this service.  There is no obligation to hire our firm.  In other words...  This is a Risk Free Offer.

Do I need an Attorney for ARD?

You need the RIGHT DUI Attorney. Only Attorney Morgan has dedicated 100% of his efforts to Pennsylvania DUI Defense.   As a former police officer and DUI prosecutor, Attorney Morgan has the advanced traning and experience necessary to achieve the best possible results.

Attorney Morgan provides accurate information to help you make the right decision in a no-pressure environment.  If ARD is the right choice for you, we will make that recommendation.  If trial is a better option, we will explain the specific reasons for our recommendation.  ARD requires compliance with the terms and conditions set by the court.  Thus, there is a risk of failure.   Unlike many attorneys, we follow your progress as you move through the ARD Program.  Click here for a free case evaluation, free legal guide, and free case-results and client reviews.

What are the Negative Aspects of ARD?

You should be aware of the following facts:

  • Your license will be suspended for 30, 60, or 90 days.

  • There is no "bread and butter" license while on ARD

  • ARD does NOT wipe the slate clean

  • ARD remains on your PennDOT Driving Record for 10 years.

  • ARD counts as a prior conviction if you are arrested for DUI again within the next 10 years.

  • If you have a CDL, it will be disqualified for 12 months.

  • You may have to perform up to 100 hours of community service.

  • ARD probation may restrict your right to possess firearms.

  • The District Attorney has complete discretion to admit and remove you from the program.

My job, when representing an individual applying for ARD, is to review the facts and circumstances of the case, remaining vigilant to determine whether there is a possibility that the charges may be dismissed due to an evidentiary issue or whether there is a strong possibility of acquittal.  If either of these situations arises, I will make a recommendation to you as to how we should proceed.

How Much Does The ARD Program Cost?

The government requires a NON-REFUNDABLE fee between $1500.00 and $3000.00.  These costs vary by county.

ARD may NOT be your best option.  This page contains information about the ARD Program including risks.  Having the advice of an experienced DUI Defense Attorney can help you avoid these risks.     Before spending this money, you should consult with a DUI Defense attorney.   Click Here for a FREE Case Evaluation

What happens at an ARD hearing?

At the hearing, which is held in open court, the Court will formally inform the defendant of the terms and conditions of the program.  The Court will ask the defendant if he understands the terms and the conditions of the program.

The ARD program is not always the right choice for every person arrested for DUI.  Based on the facts and the circumstances of your case, you may wish to challenge the evidence against you.  That is why it is important to contact me as soon as possible to discuss your case.
