What is the ARD Program?

The ARD Program is probation without a verdict. It is not a "class." It is not an "online program." It can be 12 to 18 months of probation. It can be very expensive.

How does a DUI/ARD affect my CDL?

What are the Negative Aspects of ARD?
You should be aware of the following facts:
- Your license will be suspended for 30, 60, or 90 days.
- There is no "bread and butter" license while on ARD
- ARD does NOT wipe the slate clean
- ARD remains on your PennDOT Driving Record for 10 years.
- ARD counts as a prior conviction if you are arrested for DUI again within the next 10 years.
- If you have a CDL, it will be disqualified for 12 months.
- You may have to perform up to 100 hours of community service.
- ARD probation may restrict your right to possess firearms.
- The District Attorney has complete discretion to admit and remove you from the program.
My job, when representing an individual applying for ARD, is to review the facts and circumstances of the case, remaining vigilant to determine whether there is a possibility that the charges may be dismissed due to an evidentiary issue or whether there is a strong possibility of acquittal. How Much Does The ARD Program Cost?
The government requires a NON-REFUNDABLE fee between $1500.00 and $3000.00. These costs vary by county.

What happens at an ARD hearing?
At the hearing, which is held in open court, the Court will formally inform the defendant of the terms and conditions of the program. The Court will ask the defendant if he understands the terms and the conditions of the program.
