ARD FREQUENTLY ASKED QUESTIONS

Should I Fight My Charges?
You should consider it.  ARD is not a gift.  ARD is not a goal.  It is the lesser of two evils.  ARD is not the right choice for everyone.  Only after a full evaluation of your case can we determine if ARD is the right choice for you.   We have had success with getting DUI charges completely dismissed for first time offenses.  Click here to see our case results.

How Much Does The ARD Program Cost?
Before giving your money to the government, you should be aware that ARD is not a "gift" and is not a goal. It does NOT wipe the slate clean because it counts a conviction for subsequent arrests and remains on your driving record for a period of 10 years.

It may NOT be your best option.  This page contains information about the ARD Program including risks.  However, the government doesn't want you to know about the risks.  They want you to hand over your money, and your rights.  The government requires a NON-REFUNDABLE payment between $1500.00 and $2000.00.  These costs vary by county.  Click Here for a FREE Case Evaluation to learn defenses that maybe available.

Do I need an Attorney for ARD?
You need the RIGHT DUI Defense Attorney.  If your first call to an attorney makes you feel like ARD is the ONLY choice, you are wasting your money.  Having an experienced DUI Defense Attorney evaluate your case before you enter the ARD Program is essential to protect your rights.  Surrendering your rights to the government, without the full knowledge of the program requirements, potential defenses available to you, and a full evaluation of your case does not make sense.  Click here to learn how we can help you.

We provide accurate information to help you make the right decision in a no-pressure environment.  If ARD is the right choice for you, we will make that recommendation.  If trial is a better option, we will explain the specific reasons for our recommendation.  ARD requires compliance with the terms and conditions set by the court.  Thus, there is a risk of failure.   Unlike many attorneys, The Morgan Law Firm follows your progress as you move through the ARD Program.  We are committed to your success.  See our Success Stories and Client reviews here.

What is the ARD Program?
Although the government considers it a "gift" and some attorney's sell it as a "goal."  It is the lesser of two evils. It is probation without a verdict.   It is not a "class."  It is not an "online program."  It should not be taken lightly.

This program may offer you the possibility of restoring a clean criminal record.  DUI Arrests resolved through ARD remain on your PennDOT driving record for 10 years!   HOWEVER, ARD counts as a conviction to enhance the penalties of a second or subsequent DUI.  Also, if you are a CDL driver, your CDL privileges will be disqualified for 12 months.

Each county in Pennsylvania has a different procedure for requesting and completing the ARD.  Therefore, it is important that you work with an attorney, like me, who knows the application process in each county.  For a FREE case evaluation call 1-888-821-9446 or click here.

What are the Negative Aspects of ARD?
You should be aware of the following facts:

  • Your license may be suspended for 30, 60, or 90 days.
  • ARD remains on your PennDOT record for 10 years.
  • ARD counts as a prior conviction if you are arrested for DUI again within the next 10 years.
  • If you have a CDL, it will be suspended for 12 months.
  • You may have to perform up to 100 hours of community service.
  • ARD probation may restrict your right to possess firearms.
  • The District Attorney has complete discretion to admit and remove you from the program.
  • You must pay NON-REFUNDABLE program costs of up to $2000.00.  These costs often must be paid up-front.  The program costs are not refundable, even if your case is removed from ARD.

My job, when representing an individual applying for ARD, is to review the facts and circumstances of the case, remaining vigilant to determine whether there is a possibility that the charges may be dismissed due to an evidentiary issue or whether there is a strong possibility of acquittal.  If either of these situations arises, I will make a recommendation to you as to how we should proceed.

At the hearing, which is held in open court, the Court will formally inform the defendant of the terms and conditions of the program.  The Court will ask the defendant if he understands the terms and the conditions of the program.

CONCLUSION
