The new laws modified the Blood Alcohol Content (BAC) requirements for a DUI conviction, established penalties based on BAC and prior record, and, for the first time, applied criminal penalties to the refusal to submit to chemical testing. For the purpose of determining a prior offense, the court will look back ten years to determine if there is a prior offense. A prior offense means "a conviction, adjudication of delinquency, acceptance of ARD or other form of preliminary disposition for [a violation of the DUI laws]"

The court may sentence the defendant to a sentence which is greater than the minimum, but in no case in excess of the maximum.
